Your use of Smoft ERP products, the product website www.Smoft.io, and all other applications, software, services, websites, and related services provided by us (collectively referred to as the “Services”) is subject to the clauses set out below and any other applicable terms (collectively, the “Terms”).
“We”, “SMOFT” refers to Smoft ERP, address: Novation City, Building 15 000, Block A, 2nd Floor, Sousse.
“Subscriber” means a customer of Smoft ERP.
“User” means any user of the Services, including but not limited to subscribers, subscriber customers, forum members, and blog commenters.
These Terms constitute a legally binding agreement between you and us regarding the Services. To use the Services, you must first accept these Terms. If you do not accept them, you may not access the Services.
It is strictly prohibited to use the software to manage or develop activities that violate ethical principles, including but not limited to:
alcohol trade,
interest-based financial systems (usury or riba),
gambling,
pornography,
or any activity contrary to public morality or Islamic ethics.
In case of misuse, Smoft ERP reserves the right to suspend or terminate access immediately without refund.
Smoft ERP provides Services only to business entities. If you are a consumer under applicable consumer protection laws, you may not subscribe. By using the Services, Subscribers confirm they are not consumers.
Some Services require you to provide personal data. This includes identifiable information used to register, manage services, analyze markets, improve services, and for marketing purposes.
We collect data through different methods such as forms, emails, and communications. We retain your data only as long as necessary or legally required.
We do not share your personal data with third parties without consent, except when required by law or for service delivery.
You agree to provide accurate information, keep your password secure, and update your data regularly. You are responsible for all activities under your account.
Prices are listed on the website and may change with 30 days notice. Continued use implies acceptance of updated pricing.
All purchases are non-transferable and non-refundable.
All content, logos, designs, and materials are owned by Smoft ERP or licensors and protected by law.
User content remains the responsibility of the user.
By submitting content, you grant Smoft ERP a non-exclusive, royalty-free license to use, modify, and distribute it.
You are granted a limited, revocable license to access and use the Services for personal/business use only.
Smoft ERP does not store credit card information unless entered for automatic billing.
Services may include links to third-party websites. Use them at your own risk.
Services are provided “as is” without warranties of any kind.
Smoft ERP is only liable for direct damages and not for indirect losses.
SMOFT ERP is a modular, customizable, and configurable platform. The Publisher provides tools, modules, builders, and agents that allow each user to freely design their own management environment.
The Publisher does not intervene in the configuration, setup, or usage choices made by the User. Consequently, the Publisher disclaims all liability—whether civil, criminal, tax-related, or administrative—arising from the User’s use of the platform, regardless of its nature.
The User is solely responsible for ensuring that their use of the platform complies with the laws and regulations in force in their country of establishment.
We may communicate with you via email or website notifications.
Terms may be updated. Continued use means acceptance.
These Terms are governed by Tunisian law. Tunis courts have jurisdiction.
Inactive accounts may be disabled and eventually deleted.
If any provision is invalid, others remain in effect.
